COMBATING UNDERAGE ALCOHOL PROBLEMS THROUGH CITY ORDINANCES AND POLICE ENFORCEMENT STRATEGIES
Boise City Assistant Attorney Terry Derden has worked with Officer Galloway and Boise Police’s Alcohol Enforcement Team for the past 5 years. He serves as both a prosecutor and legal police advisor to Boise and Meridian Police. As a police advisor to both command staff and patrol, he trains hundreds of police officers a year to the current legal standard they need to meet as well as working with the department to develop new ordinances for implementation at City Council.
In this presentation, he will discuss new ordinances and city codes developed by the City of Boise designed to combat underage drinking, reduce large party house problems and hold landlord and homeowners accountable for their action and in some cases inaction. He will also talk about enforcement of these ordinances from a legal perspective including what prosecutors can do in court to reduce recidivism.
The second part of the class will cover search and seizure issues that police and Alcohol Enforcement Officers need to know when detecting, investigating, apprehending and prosecuting alcohol violations, including search warrant applications for entry as well as other alternatives to entering the premises. The class will also cover entrapment and other technical legal issues as they relate to shoulder tap operations and undercover operations designed to detect and prevent underage serving of alcohol.
